Why is it important to verify measures, markers and boundaries before buying a real estate in Nicaragua?

It is important to verify the measures, markers and boundaries for these reasons:

1. For historical reasons: Due to the confiscation of the properties made in the 80s, many properties do not have a clear and legal title. Its measures, markers and boundaries are not updated.

2. For registration reasons: The buyer must verify the measures, markers and boundaries before buying the real estate, because if there is any difference between them, the buyer will not be able to register the purchase title of the property. If there is any difference in the measure, markers and boundaries can be repaired, modified and updated by administrative or judicial way. The way to repair, modify and update the measures, markers and boundaries will depend on the particular situation of the problem that the real estate has. The administrative route is fast and not expensive. The judicial process (going to court) takes a lot of time and is much more expensive.

3.  To avoid legal conflicts with the neighboring: If the measures, markers and boundaries are not verified before the purchase, the adjoining parties may at any time initiate legal complaints against the new purchaser of the real estate, which would imply having purchased a legal conflict of ownership.

The national cadastre office located in each city, the municipal cadastre office and the real estate registry office are the institutions that by law must be visited to verify the landmarks and boundaries.

It is imperative to make a topographic plan that certifies the landmarks and boundaries of the property, this plan must be approved by the national property cadastre office. The measures, markers and boundaries must coincide physically, at the real estate registry office and at the national and municipal cadastre office. If the measures, markers and boundaries do not match, they must be updated and / or modified according to the particular case of the property.
